Former Mexican Prosecutor Faces Treason Trial

A judge will soon decide if a former Chihuahua official can be tried for treason following a botched raid that killed two Americans.

Mexico has a long and often complicated history of working with U.S. intelligence agencies. That history has now become the center of a major legal battle in the northern state of Chihuahua. The dispute threatens to redefine how foreign agents operate on Mexican soil.

César Jáuregui, the former attorney general of Chihuahua, faces a new federal charge of treason. The accusation stems from an April operation to dismantle a large drug lab in the Morelos municipality. During that raid, a vehicle in the convoy went off the road and crashed into a ravine. Two state officials and two Americans died in the accident. The Mexican victims were Pedro Román Oseguera Cervantes and officer Manuel Genaro Méndez Montes.

At the time of the crash, Jáuregui described the two Americans as instructor officers. He said they were carrying out training tasks under a binational anti-drug cooperation agreement. The operation ended without any arrests because the suspects fled the scene. Jáuregui later resigned to allow for a clearer inquiry. He was arrested in mid-October on state charges of illegal exercise of public office. A judge has now ruled that those state charges can proceed to trial.

Federal prosecutors have now added the more serious charge of treason. They argue that Jáuregui endangered national security by allowing U.S. agents to join a field operation. In Mexico, that decision is usually reserved for the federal government. The charge carries a sentence of five to forty years. However, legal experts note that it is very difficult to prove in a civilian context. A federal judge is expected to decide Saturday whether the indictment will stand.

Defense attorney Héctor Villasana said prosecutors told a closed hearing that they wanted an exemplary punishment. He linked this desire to the recent U.S. removal of Venezuelan President Nicolás Maduro. The U.S. State Department said it is watching the case closely. However, the department did not link the legal action directly to the deaths of the two Americans. Their roles have been described in different ways. The U.S. ambassador called them embassy personnel. Other sources said they were CIA agents. Mexico's security ministry noted that one entered as a visitor and the other had a diplomatic passport. Neither had formal accreditation for operational activities.

Legal scholars are skeptical that the treason charge will hold up in court. Samuel González, a former chief prosecutor, argued that Jáuregui may have failed in his duties. He said allowing foreign agents to carry weapons without notifying federal authorities was a mistake. But he maintained that this is not treason, which he described as a wartime crime. Carlos Pérez Ricart from CIDE university said the case will have a large public impact even if it is dismissed. He called it a political decision made ahead of the 2027 midterm elections. He warned that the move sends a very bad signal to Washington.

U.S. agencies have operated in Mexico for many years. Former President Andrés Manuel López Obrador tried to limit their activities. Current President Claudia Sheinbaum has amended the Constitution to bar field operations without express Mexican authorization. Experts say these actions often happen without federal knowledge. Without clear rules, such collaborations can lead to abuses of power. The Jáuregui case will now test how strictly those new rules are enforced.
